1 One Juror's response to the counts against Tim, the law, and the verdict that she felt forced to render. This juror stuggled with the desire to disregard the law, which she felt was unfair to the defendant since the conduct was consensual, and her sworn duty to follow the law, which she felt required the verdict rendered.

3 With the 6th Circuit ruling the 2257 status being unconstitutional, Tim filed a motion that his conviction should be reversed. Of the eleven counts for which he was found guilty, two were directly 2257 counts. A spillover affect was also argued because the prosecution argued, during their closing remarks at the trial, that his lack of compliance to the 2257 laws was clear evidence that he was guilty of the other charges..

Tim moves to have the evidence obtained from his servers suppressed. The motion is based upon the fact that neither he nor any of his web sites were named in the warrant used to search his server. Only Justin Berry and his websites were named in the warrant. At a minimum the government had an obligation to come back to the court to ask for permission to search beyond the web site, JustinFriends.com, which was the only website named in the warrant.
