Happy new year everyone.
Sorry to jump in out of nowhere and ask, but hopefully I will be hungover for a few days and wont remember... I was a bad boy and Pacer shut off my account because my bill was ummm almost a mortgage payment. Anyhow, was wondering if anyone had seen the what the governments response to mitchels short novel that he filed a few months ago is? I think it was due in december sometime...
My interest is peeked because I think his first attorney was a puppet for the government- it was way too easy- I dont know the guy but you have to have a tiny bit of sympathy for someone who has a lawyer that sucks that bad.

| I know a few BAD ambulance chasers/conmen that will have us believe they are vigourously defending the accused. They are really puppets and agents for the state. They always believe any child when an adult is involved, even the brats that drink smoke and do drugs because they are coached by the prosecutors and look like angels on the stand. I know of one teacher that was falsely accused and was therefor removed from the classroom pending an investigation. When the little angel admitted to making a false claim about some inappropiate touching he was allowed to return. He told them to stick their job up there ass. He said he would never allow himself to be left vulnerable to the system again. Some teachers or will not help a 5-7 yr old which are the ones that can't do some things we take for granted. One kid forgot to close his fly. Some can't tie there shoes. When the child cries like most kindergarden children sometimes do a teacher can no longer comfort the child. It is not only the child that complains but the child may tell their parents that a teacher merely hugged them and that could lead to a trial which cost no less that $100,000 today. I bet Casey's transcript fees were at least $5,000. Trial lawyers want 5-10 grand per day just for the trial. The Salem Witch Hunt has been replaced by the "To Catch a Predatory." public thinking. Oneday everyone in the usa will know someone caught up in this modern day burning at the stake. We will curse the day computers were invented. This is nothing but a jobs program for the court system,Judges,Wardens,DOJ,lawyers,guards,doctors,sex offender evaluators court reporters newpaper reporters,law clerks, administration,etc.etc. Many people benefit when we build more prisons, plumbers,masons,bulldozer operators, etc. etc people that benifit from your loved one or maybe you being incarserated is endless. America has 2.2 million of it's "RIGHT TO PURSUE HAPPINESS" citizens in jail. Even evil empires like China or Russian or even Irag pre Sadam don't have as many. We should be appalled because China alone has a billion people on its soil nd we have 320 million. The percentage doesn't lie. SHAME ON THE HUMAN RACE. IF GOD REALLY DID give us life then I would give him a D-!!!!!! |

Mitchel's original PETITION FOR RELIEF was filed in July of 2009. The Government's RESPONSE TO PETITIONER’S MOTION FOR RELIEF was filed at the last minute yesterday, December 31, 2009.
It seems to me that Mitchel’s strongest argument surrounds Court 1 and the statements in that count that suggested that John Doe 1 (Berry) was underage when a certain video was filmed. In the sentencing hearing, the Government clearly stated that the video in question, one that many of us know well, was filmed when John Doe 1 was 18. Thus there would have been only one victim in this count and the evidence presented at sentencing corroborated the defendant’s position that there was only one victim. Yet the court allowed a two victim enhancement to stand on this count (an enhancement which unfortunately Mitchel’s lawyer didn’t contest). I think this pushed Mitchel into an enhancement level that resulted in a life sentence.
In the Government’s response (and I need to review the sentencing transcripts to be sure) they are trying to bring forward evidence that was not presented at sentencing.

This presents an interesting situation. The Government obviously needs Greg Mitchel to make a case against somebody. While there is a possibility of them going to Greg in order to file another case against Casey, I think it is something else.
The Government may have gotten tired of all the crap Justin Berry pulled. Remember, if they feel that he lied in any way about what he told the Government, they can pull his immunity agreement at any time. In addition, there was a case filed against Justin's father Knute. Nobody knows the specifics of that case, and it has received very little publicity. Perhaps this is a move on that case. |
